Consistency with the New Zealand Bill of Rights Act 1990: Fire and
Emergency New Zealand (Levy) Amendment Bill
- We
have considered whether the Fire and Emergency New Zealand (Levy) Amendment Bill
(the Bill) is consistent with the rights and freedoms
affirmed in the New
Zealand Bill of Rights Act 1990 (the Bill of Rights Act).
- The
Bill amends Part 3 of the Fire and Emergency New Zealand Act 2017
to:
- impose
a levy on contracts of insurance for fire damage;
- change
the basis of the calculation of the levy from ‘amount insured’ to
the ‘sum insured’ under an insurance
policy;
- clarify
how the levy applies to motor vehicles; and,
- amend
the commencement date of Part 3 to allow time for levy regulations to be
made.
- We
have concluded that the Bill appears to be consistent with the rights and
freedoms affirmed in the Bill of Rights Act.
