Disputes Tribunals Amendment Bill (Consistent) [2009] NZBORARp 12 (20 March 2009)

Last Updated: 28 April 2020

Disputes Tribunals Amendment Bill

20 March 2009

Attorney-General

Disputes Tribunals Amendment Bill

Our Ref: ATT395/98

I have reviewed the Disputes Tribunals Amendment Bill for consistency with the New

Zealand Bill of Rights Act 1990. I understand that the Bill is to be introduced on 24 March

2009.

The Bill proposes to amend the Disputes Tribunals Act 1988 by increasing the maximum claim level from $7,500 to $15,000, and from $12,000 to $20,000 with the consent of both parties. The Bill is intended to improve access to the Disputes Tribunal by raising the maximum claim level to reflect changes in the economic environment and the rising costs of litigation since it was last increased in 1988.

None of the provisions in this Bill appear to be inconsistent with the Bill of Rights Act.

In accordance with Crown Law practice, this opinion has been peer reviewed by Ben Keith, Crown Counsel.

Yours sincerely

Victoria Casey

Crown Counsel
